1.8 We are NOT a property sales or lettings agency. We provide the Platform -- a self-service marketplace where users independently list properties for sale, purchase, or rental. We do not act as an agent, broker, or intermediary for any transaction.

1.9 For legal, security, or urgent data matters, please clearly state the nature of your enquiry in the subject line of your email.

2.1 These Terms set out all rules and obligations that apply to your use of the Platform.

2.2 By using the Platform, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Platform.

2.3 If you access the Platform through the App, by downloading and using it, you agree to be bound by these Terms. We grant you a limited, non-transferable, non-sublicensable, non-exclusive, revocable licence to download and use the App on any compatible device. We reserve all rights in the App. You have no right to access the App in source code form.

2.4 You must be at least 18 years of age to use the Platform. By using the Platform, you confirm that you meet this requirement. Users aged below 18 must not register or use the Platform.

2.5 These Terms are supplemented by our Privacy Policy, Cookie Policy, and any other applicable policies, which together form our complete agreement with you. We recommend you retain a copy of these Terms.

3.1 We may amend these Terms at any time. If material changes are made, we will provide reasonable notice via email or on-Platform notification where practicable, and will update the date above. Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance. If you do not agree, you must stop using the Platform immediately.

4.2 We are not a party to any transaction, agreement, or negotiation between users. All dealings are strictly between the buyer/seller/landlord/tenant. We bear no responsibility for the outcome of any such dealings.

4.3 We reserve the right to remove, edit, or refuse any listing at our sole discretion, without notice and without liability.

4.4 The Platform is made available free of charge to general users. We reserve the right, without notice or liability, to: amend or update all or any part of the Platform; withdraw your access; or suspend or discontinue all or any part of the Platform.

5.1 You are solely responsible for ensuring that the device you use to access the Platform meets all necessary technical specifications.

5.3 You must not upload offensive, discriminatory, or inappropriate content, or solicit commercial services through any communication on the Platform.

5.5 Responsible Disclosure: If you discover a security vulnerability in the Platform, please report it immediately and confidentially to premiumproperty4you@gmail.com with the subject line: SECURITY DISCLOSURE. Do not disclose vulnerabilities publicly before we have had a reasonable opportunity to investigate and resolve them.

6.2 All content you submit to the Platform (User Content) is considered non-confidential and non-proprietary. You grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable licence to use, copy, modify, adapt, distribute, store, perform, and display such content for any lawful purpose. Personal information will be processed per our Privacy Policy.

6.4 You should only use enquiry forms to submit genuine enquiries. We are not liable for delays in transmission. We reserve the right to withhold any suspicious enquiry from transmission, without notice.

6.5 Where we believe a breach of this clause has occurred, we may: withdraw your access; remove listings or User Content; disclose information to law enforcement; and/or take further legal action.

6.6 We reserve the right to remove any User Content or listing at any time, without notice and without reason.

6.7 The views expressed on the Platform by users or others do not represent our views or values.

6.8 We may use artificial intelligence (AI) technologies to enhance Platform features. AI-generated content may be labelled accordingly. AI can be inaccurate -- always verify important property information independently before relying on it.

7.1 To list properties or access certain services, you must register a free account. Registration is only permitted for individuals aged 18 or older. We may refuse any application at our discretion.

7.2 Each registration is for a single user only. You must not share your credentials with any other person.

7.3 You must use a unique, strong password and must not reuse passwords from other accounts. We recommend enabling two-factor authentication (2FA) where available.

7.4 You are solely responsible for all activity under your account. You must notify us immediately of any unauthorised use at premiumproperty4you@gmail.com.

7.5 We may require a password change, or suspend or cancel your account, if we reasonably believe it has been compromised or these Terms have been violated.

7.6 We are not liable for any loss arising from your failure to protect your account credentials.

7.7 All personal information provided during registration will be processed per our Privacy Policy.

8.1 The intellectual property rights in the Platform and Platform Content (including all text, images, graphics, databases, software, code, trade marks, logos, and other materials) belong to us or our licensors. All rights are reserved.

8.2 No licence or right is granted to you to use any of our intellectual property, including any trade mark or logo of PREMIOVA PROPERTIES LLP.

8.3 For personal, non-commercial use only: you may download material from the Platform only where we provide a specific download option. You must not copy, reproduce, redistribute, adapt, frame, or otherwise exploit any material from the Platform without our prior express written consent.

9.1 We take the protection of your personal data seriously. All personal data collected through the Platform is processed in accordance with our Privacy Policy and applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act).

9.2 By using the Platform, you consent to the processing of your personal data as described in our Privacy Policy. You have the right to access, correct, and erasure of your personal data. To exercise these rights, please contact: premiumproperty4you@gmail.com.

9.3 We implement appropriate technical and organisational measures to protect your data. However, no internet transmission is entirely secure, and we cannot guarantee absolute security.

9.4 We will never sell your personal data to third parties for their own marketing purposes without your explicit consent.

10.1 The Platform is provided on an "as is" and "as available" basis. We do not warrant that access to or use of the Platform will be uninterrupted or error-free.

10.2 We do not verify or guarantee the accuracy, authenticity, or legality of any property listing submitted by users. All listings are posted at the sole responsibility of the user who creates them.

10.3 Platform Content is for general information only and does not constitute legal, financial, or professional property advice. You should seek appropriate professional advice before making any property transaction decision.

10.4 To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms that may apply to the Platform or Platform Content.

11.1 We are committed to preventing fraud and misrepresentation on the Platform. We may implement identity verification or anti-fraud checks on users and listings at our discretion.

11.3 We may report any suspected fraudulent or criminal activity to the relevant law enforcement authorities, including the police and regulatory bodies, without notice to you.

12.1 The Platform is a marketplace only. We are not a party to any sale, purchase, rental, or other transaction agreed between users. We do not hold any money, deposits, or escrow on behalf of users.

12.2 You are solely responsible for conducting appropriate due diligence before entering into any property transaction with another user. We strongly recommend obtaining independent legal and financial advice before completing any transaction.

12.3 We are not liable for any loss, dispute, fraud, or damage arising from any transaction or communication between users of the Platform.

13.1 We reserve the right to bar users from the Platform and restrict or disable their access to any element of our services, on a permanent or temporary basis, at our sole discretion and without notice.

13.2 Where we suspect a security incident, fraudulent listing, or serious breach of these Terms, we may immediately suspend access to any account pending investigation, without liability.

14.1 The Platform is operated from India and is primarily directed to users within India. We do not warrant that the Platform or Platform Content is appropriate for use in, or complies with the laws of, jurisdictions outside India.

14.2 These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ernakulam, Kerala, India.

14.3 Any dispute not resolved amicably may be referred to arbitration under the Arbitration and Conciliation Act, 1996 (India), with the seat of arbitration in Ernakulam, Kerala.

15.1 The Platform may contain links to third-party websites. We do not control and are not responsible for those websites. Links are provided for convenience only and do not constitute our endorsement. You access any third-party website at your own risk.

16.1 We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

18.2 Any ideas, suggestions, or feedback you provide are entirely voluntary, and you agree that we may use such feedback without compensation or obligation to you.

19.1 These Terms, together with our Privacy Policy and any other applicable policies, constitute the entire agreement between you and PREMIOVA PROPERTIES LLP in relation to your use of the Platform.

19.2 If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19.3 Our delay or failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

19.4 We may assign or transfer any of our rights and obligations under these Terms at any time. You may not assign or transfer your rights or obligations without our prior written consent.

19.5 Nothing in these Terms creates any partnership, joint venture, employment, franchise, or agency relationship between you and us.
